Terms of Use

These Terms of Use govern your use of HeyVar, a digital career exploration and professional development platform operated by Folksnest UG (haftungsbeschränkt). By creating a HeyVar account, you confirm that you have read and agree to these Terms.

1. Who operates HeyVar

HeyVar is a brand operated by Folksnest UG (haftungsbeschränkt), Landsberger Str. 303, 80687 München, Germany, represented by Alicia Dick Wahlberg, Managing Director (info@folksnest.com). Registered with Amtsgericht München, HRB 305063. VAT ID: DE459212557. HeyVar is currently being developed and tested; this information will be updated if the company’s registered name or address changes.

2. Who can use HeyVar

You must be at least 15 years old to create a HeyVar account or use the platform; by creating an account, you confirm you meet this requirement. Where applicable law requires additional consent or safeguards for users under the age of majority, those requirements remain unaffected. If you use HeyVar on behalf of another person or organization, you confirm you are authorized to do so.

3. What HeyVar is

HeyVar is a digital career exploration platform designed to help people understand and present their professional experience, skills, career preferences, and the types of work environments in which they may thrive — including building a career profile, uploading a resume, recording preferences and availability, optionally providing third-party assessment results, receiving AI-assisted summaries and insights, and, as these features become available, receiving job recommendations. HeyVar is a career exploration and information service — it does not guarantee employment, interviews, job offers, career progression, or any particular outcome.

4. Creating a HeyVar account

Some features require an account, created via email/password or supported third-party sign-in (Google, Apple, or LinkedIn). You’re responsible for keeping your account information accurate and up to date, and for keeping your credentials secure and activity carried out through your account, unless caused by a security issue not caused by you. Contact info@folksnest.com if you believe your account was accessed without authorization.

5. Your career profile

You’re responsible for the information you add to your profile — name and contact information, location, employment history, education, skills, resume/CV, career goals, availability, salary expectations, relocation preferences, optional assessment results, and any other information you choose to provide. You should not upload information belonging to another person without a lawful basis and permission, and should avoid uploading unnecessary sensitive personal information about yourself or anyone else.

6. Resumes and uploaded documents

You confirm you have the right to provide any documents you upload for the purposes described in our Privacy Policy. HeyVar may process uploaded documents to identify or suggest skills, generate profile summaries, highlight relevant information, and help structure your career profile. You remain responsible for reviewing and correcting information generated from your documents.

7. Optional assessments

HeyVar may let you provide results from third-party assessments (such as VIA Character Strengths or CliftonStrengths), where presented as optional. HeyVar does not conduct these assessments and does not control their methodology, accuracy, or availability. Providing a report to HeyVar authorizes us to process it as described in these Terms and our Privacy Policy.

8. AI-assisted features

HeyVar uses AI, currently including the Google Gemini API, to generate suggested skills, summaries, profile highlights, career insights, work environment comparisons, and potential matches from the information you provide. AI-generated information may contain errors or inaccurate conclusions and should be treated as guidance rather than a factual or professional determination — you remain responsible for reviewing it.

9. Career insights and matching

Where available, HeyVar may suggest roles, organizations or opportunities based on your profile. These suggestions are recommendations only — HeyVar does not guarantee that a recommendation is suitable, accurate, complete or available, and a recommendation is not a decision about your employment or professional suitability. HeyVar does not intend to make hiring, promotion or rejection decisions solely through automated processing.

10. Profile visibility and employer access

During the current testing phase, hiring companies do not have access to candidate profiles through HeyVar unless we expressly tell you otherwise. If employer discovery or matching features are introduced, we will provide information about how your profile may be used and what visibility controls are available — review your visibility settings carefully before making your profile discoverable.

11–12. Your responsibility and acceptable use

You agree to provide accurate information, update it when it becomes materially inaccurate, and must not impersonate another person or misrepresent your identity, qualifications, employment history, education or experience.

  • No unlawful, fraudulent, or abusive use
  • No unauthorized access to accounts, systems or data
  • No interference with HeyVar’s operation or security, malicious code, or unauthorized scraping
  • No reverse engineering except where permitted by law
  • No harassment, threats, discrimination, or harm to another person
  • No treating AI-generated information as a professional or legally binding assessment

We may restrict or suspend access where reasonably necessary to protect HeyVar, our users, or third parties, including for serious or repeated violations of these Terms.

13–14. Your content and HeyVar’s IP

You retain your rights in the personal information, resumes, documents and other content you provide. You grant HeyVar the limited rights necessary to host, store, process, display and analyze your content to provide and improve the features you use. HeyVar does not acquire ownership of your resume or personal content simply because you upload it.

The HeyVar name, branding, website, software, interface and related intellectual property are owned by or licensed to Folksnest UG (haftungsbeschränkt). You may use HeyVar for your own career exploration purposes, but may not copy, reproduce, distribute, or commercially exploit our proprietary materials without permission, except where permitted by law.

15. Third-party services

HeyVar may integrate third-party services including Google, Apple, LinkedIn, Google Maps, Google Analytics, Google Gemini, HubSpot, Calendly, YouTube, Spotify, and IONOS. Your use of these services may also be subject to their own terms and privacy policies; HeyVar is not responsible for services independently operated by third parties. 16–18. Availability, changes, and statutory rights

HeyVar is currently being developed and tested. We aim to keep it available and reliable but cannot guarantee uninterrupted or error-free access — HeyVar may be temporarily unavailable for maintenance, updates, security measures, technical problems, or events outside our control, and we may add, remove or change individual features over time. Where German statutory rules governing digital products apply — including where you provide personal data in exchange for access to a digital service — your mandatory statutory rights concerning conformity, updates, defects and changes remain unaffected, and nothing in these Terms is intended to exclude or limit them.

19–20. Account termination

You may stop using HeyVar and request account deletion at any time via info@folksnest.com or in-product deletion functionality. We may suspend or terminate an account for serious or repeated Terms violations, security or legal risk, or where required by law, considering the circumstances and impact on you first; mandatory statutory rights remain unaffected. When your account is deleted, we delete or anonymize your personal information per our Privacy Policy, unless legally required or permitted to retain certain information temporarily.

21. No employment guarantee

HeyVar is not a recruitment agency and does not guarantee employment, interviews, job offers, a particular salary, career advancement, employer acceptance, or the availability of any role. Using HeyVar does not create an employment relationship between you and HeyVar; career insights and recommendations are intended to support your own decision-making.

22–23. Additional services and liability

HeyVar may offer additional consulting, coaching or workshop services in the future under a separate agreement. HeyVar is liable in accordance with applicable law — nothing in these Terms excludes or limits liability where prohibited by law, including for intentional or grossly negligent conduct, injury to life, body or health, breaches of mandatory statutory obligations, or express guarantees. You remain responsible for your own professional and career decisions.

24. Data protection

The processing of personal data through HeyVar is governed by our Privacy Policy, which explains what we collect, why, our legal bases, how AI and third-party services are used, retention, and your rights. It forms part of the information governing your use of HeyVar but does not replace these Terms.

25–26. Language, storage, and changes

The contractual language for the use of HeyVar is English, and the current version of these Terms remains available on the HeyVar website — you should save or download a copy for your records. We may update these Terms as HeyVar develops or legal requirements change; where a change materially affects your rights, we will provide appropriate notice and, where required, an opportunity to review and accept the update. The applicable version is identified by its last-updated date.

27. Governing law

These Terms are governed by the laws of the Federal Republic of Germany, subject to mandatory consumer protection provisions that may apply in your country of residence. If you are a consumer, nothing here removes mandatory rights under the law where you live. Any agreement on exclusive jurisdiction of German courts applies only where legally permissible.
